2. The Creative Print Service

The Creative Print is a Print-on-Demand (POD) service. This means:

• Custom Production: All products are unique and produced specifically for you when you place an order.
• Order Fulfillment: Orders are fulfilled by third-party print providers and logistics partners.
• Order Acceptance: Orders are only considered accepted and confirmed once payment has been received and you receive an Order Confirmation email.

3. User Accounts

• Registration: To access some features of the service, you may be required to register for an account.
• Account Responsibility: You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
• Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.

4. Intellectual Property and Content

4.1. Your Submitted Content

• Ownership: You retain all ownership rights to the creative content (designs, images, text, etc.) you upload or submit to be printed on our products
• License to Us: By submitting User Content, you grant The Creative Print a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and modify the User Content solely for the purpose of fulfilling your order and providing the Service.
• Warranties: You warrant that:
  • You have the necessary rights, licenses, or permissions to use the User Content and authorize us to use it for your order.
  • The User Content does not infringe upon the intellectual property rights (including copyrights, trademarks, and design rights) or other rights of any third party.
• Prohibited Content: You agree not to upload, submit, or create any designs that:
  • Are unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or racially, ethnically, or otherwise objectionable.
  • Infringe on the intellectual property, privacy, or publicity rights of any third party (e.g., brand logos, copyrighted characters, etc.).

4.2. Our Intellectual Property

All content on the website (excluding User Content), including text, graphics, logos, and software, is the property of The Creative Print or its content suppliers and is protected by US and international copyright laws.

5. Product and Pricing

• Pricing: All prices are listed in United States Dollars (USD). We reserve the right to adjust prices without notice. The price charged to you will be the price listed at the time you place your order.
• Product Representation: We strive for accurate color and design representation. However, we cannot guarantee that the color displayed on your computer monitor will exactly match the product color due to variations in digital displays.
• Taxes: Prices displayed do not include applicable sales tax. Sales tax will be added to your order as required by US state laws.

6. Payment, Shipping, and Returns

6.1. Payment and Order Cancellation

• Payment: We accept paypal as our primary payment method
• Cancellation: Due to the custom, on-demand nature of our products, orders enter production quickly. Once an order has entered production cancelations are not possible

6.2. Shipping and Delivery

• Separate Policy: Details regarding shipping methods, estimated delivery times, tracking, and risk of loss are outlined in our separate Shipping Policy, which is incorporated into these Terms by reference.
• Accuracy: You are responsible for ensuring the delivery address provided is complete and accurate. We are not responsible for delays or losses due to incorrect address information.

6.3. Returns and Refunds

• Separate Policy: Our policy on returns, exchanges, and refunds is outlined our Return & Refund Policy
• Defective/Incorrect Items: Because products are custom-made, we generally do not accept returns for buyer’s remorse or size/fit issues. However, if an item is defective (e.g., printing error, damaged upon arrival) or you received the wrong item, please contact us within 14 days of delivery with photographic proof.

7. Disclaimers and Limitation of Liability

The Creative Print provides the website and service on an “as is” and “as available” basis.

• No Warranties: We make no express or implied warranties regarding the operation of the website or the information, content, or materials included on this site.
• Limitation of Liability: To the fullest extent permitted by law, The Creative Print shall not be liable for any indirect, incidental, punitive, or consequential damages (including lost profits) arising from or related to your use of the service or the purchase of products. Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for the products in question.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
